ThumbClick ("Service") is an AI-powered YouTube thumbnail generator operated at thumbclick.es. The Service uses Google's Gemini AI to generate thumbnail images based on your uploaded photos and text prompts.
You must be at least 13 years old to use the Service. By using ThumbClick, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at rodri@syncralabs.es if you suspect unauthorized access.
Free plan: New accounts receive 3 free credits. Guests (without an account) may generate up to 2 thumbnails per day.
Pro plan ($12/month): 50 credits are granted at the start of each billing cycle.
Creator plan ($27/month): 200 credits are granted at the start of each billing cycle.
Credits are non-transferable, non-exchangeable for cash, and expire at the end of each billing cycle. Unused credits do not roll over to the next cycle.
Subscription prices may change with 30 days notice. Continued use after notice constitutes acceptance of new pricing.
Due to the nature of AI-generated content and immediate credit consumption, all purchases are final and non-refundable, except where required by applicable law.
If you experience a technical issue that prevents you from using credits you paid for, contact us at rodri@syncralabs.es within 7 days and we will review your case.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate these terms without refund.
Your content: You retain ownership of photos and prompts you upload. By uploading, you grant ThumbClick a limited license to process them solely for the purpose of generating your thumbnail.
Generated thumbnails: You own the thumbnails generated using your inputs and may use them for any lawful purpose, including commercial use on YouTube or other platforms.
ThumbClick's IP: The ThumbClick brand, logo, website design, and software are owned by us. You may not copy, reproduce, or create derivative works without our written permission.
The Service uses Google Gemini AI. While we strive for high-quality results, AI-generated content may occasionally be inaccurate, incomplete, or unexpected. We do not guarantee specific results from any generation. You are responsible for reviewing generated content before publishing it.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THUMBCLICK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO THUMBCLICK IN THE 3 MONTHS PRIOR TO THE CLAIM.
You may delete your account at any time from your profile settings. We may suspend or terminate your account for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Any credits or subscription fees already paid are non-refundable except as required by law.
You agree to indemnify, defend, and hold harmless ThumbClick, its operators, affiliates, and their respective officers, directors, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
Informal resolution first: Before filing any legal claim, you agree to contact us at rodri@syncralabs.es and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration: If informal resolution fails, any dispute arising from or relating to these Terms or the Service shall be resolved by binding arbitration administered online through a mutually agreed provider. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding.
Class action waiver: You agree to resolve disputes with us on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding against ThumbClick.
Exceptions: Either party may seek injunctive or equitable relief in any court of competent jurisdiction for claims related to intellectual property infringement or unauthorized access to the Service.
ThumbClick shall not be liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to: natural disasters, pandemic, war, terrorism, government actions, power outages, internet disruptions, third-party API failures (including Google Gemini or Stripe outages), cyberattacks, or acts of God.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ThumbClick regarding the Service and supersede all prior agreements and understandings.
We may update these Terms at any time. We will notify you by updating the "Last updated" date. Continued use of the Service after changes constitutes your acceptance of the new Terms.
